Terms and conditions
1. Introductory provisions
These terms and conditions (hereinafter “Terms”) govern the mutual rights and obligations between Betonpres a.s., Company ID 60646551, VAT ID CZ60646551, with its registered office at Kočín 45, 375 01 Temelín, registered in the Commercial Register kept by the Regional Court in České Budějovice, file no. B 2379 (hereinafter “Provider”), and the customer (hereinafter “Customer”) when ordering and providing the satellite roof measurement service ordered via the Provider’s website.
The Customer may be either a consumer or a business. If the Customer is a consumer, relationships not governed by these Terms are governed by Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended.
2. Subject of the service
The subject of the service is a satellite measurement of the Customer’s roof and the preparation of an indicative list of the material required for the roof covering, based on the data entered by the Customer (the address of the property and the marking of the roof on the map).
The measurement is carried out by an external third party. The Provider passes the order data, including a map extract with the marked roof outline, to this third party. The result of the measurement is sent to the Customer at the e-mail address given in the order.
3. Order and conclusion of the contract
The order is placed in the following steps:
- selection of the roof covering,
- entry of the property address,
- marking of the roof on the map,
- entry of contact details and payment of the service price.
By submitting the order, the Customer confirms that they have read these Terms and agree with them. The contract between the Provider and the Customer is concluded at the moment the payment of the service price is credited to the Provider’s account.
4. Price and payment terms
The price of the satellite roof measurement service is CZK 1,000. The price is payable in advance online via the GoPay payment gateway. After successful payment, the Customer will receive an order confirmation at the e-mail address provided.
5. Delivery of the service
The Provider, or the external processor, will usually complete the measurement within 3 working days of the payment being credited. The result is sent to the Customer at the e-mail address given in the order.
If the roof cannot be measured for technical reasons (e.g. insufficient satellite imagery), the Provider will inform the Customer and will arrange any cancellation and refund of the price with the Customer individually.
6. Withdrawal from the contract
If the Customer is a consumer, they have the right under Section 1829 of the Civil Code to withdraw from a contract concluded at a distance within 14 days. The Customer acknowledges that they request the provision of the service to begin before the expiry of this period; in accordance with Section 1837(a) of the Civil Code, the right of withdrawal ceases to exist if the service has been performed before the expiry of the withdrawal period.
7. Complaints
The rights and obligations of the contracting parties arising from defective performance are governed by the applicable legal regulations. The Customer is entitled to raise any defects in the service with the Provider using the contact details given below.
8. Protection of personal data
The processing of the Customer’s personal data is governed by the Provider’s Privacy Policy.
9. Final provisions
These Terms and the relationships arising from them are governed by the laws of the Czech Republic. The Provider is entitled to amend these Terms; the version in effect on the date the order is submitted is binding for the Customer.
